MUMBAI: The urban development department of the state has suggested that all BMC and Mhada rehab homes have a floor area of 405 square feet.

Section 15 of the notification reads, “The fungible compensatory area admissible on rehab component will be given without charging a premium and such reusable compensatory area for rehabilitation section shall not be used for free sale component and shall be used to give extra area over and above the eligible area to the existing tenants.”

Introduced in 2012, the fungible compensation area comprises 35% of the total built-up area. In order to facilitate the provision of larger homes—with 105 square feet of carpet area in addition to the required minimum of 300 square feet for a rehab apartment—it is provided to the builder without charge.

Developers, however, have insisted that this extra space is optional and cannot be provided because it would render the project unfeasible.

Now that the government has made it clear that it must be used to provide renters with more space, builders won’t be able to avoid it going forward.

The notification clears the way for the demolition of 19 BMC-owned buildings in central Mumbai that are required to be removed for the construction of the Bandra-Sewri connector. This connector will form an important link between the Bandra-Worli Sea Link and the Mumbai Trans-Harbour Link.

According to the announcement, each occupant undergoing rehabilitation will receive a minimum fixed carpet area of 27.88 square feet (300 square feet) or a maximum of 120 square feet (1,292 square feet).

If a building is deemed unsafe, the BMC/Mhada’s reconstruction requires the consent of 75% of the tenants. A tripartite agreement between the tenants, developer, and BMC/Mhada will be signed, and occupiers will be compelled to pay the premium.

MUMBAI: According to an action plan created by the civic body, if builders do not take action to reduce the dust produced from construction sites, the BMC would issue stop-work warnings to them and take legal action if necessary.

If contractors fail to self-certify that a construction project complies with dust mitigation standards, such as installing metal sheets around the perimeter of the site, water-fogging during excavation, loading/unloading construction materials, and periodically sprinkling soil strata before excavation begins, civic action will follow.

The offense is punishable under the Maharashtra Regional and Town Planning Act (MRTPA) with a sentence of one month to three years in prison. For instance, if a project proponent, architect, or land surveyor fails to provide self-certification about compliance with the dust mitigation criteria on the BMC website, a warning letter will be sent to the proponent for rectification/compliance within a week.

If the builder continues to disobey, additional sanctions under the MMC Act or MRTPA, including the issuance of a stop work notice, would be taken.

On the first occasion of non-compliance, a warning letter will be issued by a task force at the ward level that will visit project sites to inspect compliance. Also, the task force will give the concerned assistant commissioner a weekly report on the actions performed.

These are parts of the report submitted to municipal commissioner IS Chahal last week, which has been accepted. “The report has been submitted and accepted and implementation will start at the earliest,” said additional municipal commissioner Dr. Sanjeev Kumar.

Chahal appointed a seven-person team two weeks prior to determine the dust management techniques that Mumbai must begin using on April 1. A copy of the paper, which outlines immediate, short-term, and long-term actions that Mumbai must take to address escalating dust pollution issues that residents have been raising for many months, is with TOI.

Mumbai’s air quality index (AQI) has been consistently in the poor category prior to the unseasonal rains that the city experienced earlier this month, leading the authorities to propose alternatives.

The contractor in question will follow the same procedure for civic infrastructure projects, where continuous metal barricades must be placed at work sites prior to the start of excavation or trenching work, sand, and other construction materials must be stored at designated locations, and all debris must be removed within 24 hours.

HYDERABAD: Amid the din, the GHMC budget of 6,224 crores for the fiscal year 2023-24 was approved at its fifth general assembly meeting on Saturday. No discussion on the budget or the agenda took place due to protests from both BJP and Congress corporators, as mayor Gadwal Vijayalakshmi quickly called for a vote after her efforts to calm the members of the opposition failed.

The GHMC has reduced the fiscal budget for 2022-23 from 6,150 crores to 6,475 crores. The civic body has allocated 25% of its expenditure, or 1,530 crores, in the 2023-24 budget for new roads, flyovers, bridges, road under bridges (RuBs), road under bridges (RoBs), and traffic signals.

775 crore has been set aside for the strategic road development program (SRDP), 150 crore for the comprehensive road maintenance program (CRMP), and 605 crore for other road construction and maintenance. The budget for land acquisition has been set at 700 crores, nala expenditure at 510 crores, and street lighting at 240 crores.

GHMC has set aside 450 crores, or 7% of its total spending, for debt servicing (paying loans). The interest component alone accounts for 390 crores.

Furthermore, the GHMC estimates that borrowings will account for 20% of total receipts (1,218 crores). According to the budget revenue details, the civic body would obtain around 2,000 crores from property taxes, accounting for 32% of total receipts.

“The increase in property tax receipts is due to the 100% evaluation of new characteristics and mutation automatically on property registration without human interface,” according to a GHMC press release.

The estimated revenue for the fiscal year 2022-23 for the town planning wing is Rs. 1,750 crores, accounting for 28% of total receipts. Protests erupted during the general body meeting after BJP and Congress corporators requested that other items on the agenda take priority over the budget discussion.

On the other hand, the mayor insisted on sticking to the agenda. Soon after, opposition party corporators gathered around the chair, holding Congress placards with images of a road collapse in Chaknawadi lane in Goshamahal on Friday. Vijayalakshmi ultimately adjourned the meeting and blasted the BJP for failing to represent their division.

GURUGRAM: Because they failed to pay for structural audits of their city-owned residential societies, the town and country planning department (DTCP) has recommended that all projects by two developers be barred from registering sale and lease deeds.

District town planner Amit Madholia wrote to deputy commissioner Nishant Yadav, despite repeated reminders that Raheja Developers and Brisk Infrastructure had failed to deposit the audit amounts.

In the first week of August of this year, the district administration finalized a panel of four agencies to conduct structural audits of 16 housing societies where residents claimed serious flaws in construction quality.

The agencies were to be paid Rs 1.75 per sqft, with the developers footing the bill for the audit. The developers were instructed to deposit the funds in the district administration’s escrow account by the second week of September. Madholia stated that developers were reminded to deposit the audit deposit on September 24 and October 6.

The deputy commissioner called a meeting on October 28 and gave the developers seven days to pay their debts.
According to the account statements on November 11, however, the two developers made no payment, according to Madholia’s letter. If lease deed execution is halted, it will have an impact on 16 Raheja Developers projects and one Brisk Infrastructure project.

While Brisk was unavailable for comment, Raheja’s spokesperson stated, “We have requested that the department include our projects in the structural audit process despite the fact that we did not design or build them. The department has been asked to work with the agencies that built and oversaw these projects to resolve the issue. If our application is rejected, we will, however, comply with DTCP orders.”

NEW DELHI: Authorities in Delhi issued 253 challans and fined user agencies a total of Rs 32.4 lakh for failing to comply with dust control standards, according to Environment Minister Gopal Rai. As of October 6, government officials had inspected 6,868 construction sites as part of the anti-dust campaign, according to the minister.

“A total of 253 notices/challans were issued,” he said, adding that violators were fined Rs 32.4 lakh.
Construction and demolition projects larger than 500 square meters must be registered with the C&D portal, which was launched last October to combat dust pollution in the capital.

Project proponents must self-audit their compliance with dust control standards every two weeks and upload a self-declaration to the portal.

In September, the Delhi government made anti-smog guns mandatory at all construction and demolition sites larger than 500 square meters.

If a project proponent is found to be in violation of this directive, action is taken against them.
Construction and demolition sites with more than 20,000 people were previously required to install anti-smog guns to control dust pollution.

The land has always been clearly exempt from GST. However, a never-ending battle erupted over whether the sale of plots following basic development is subject to GST. This case is nearing its end.

MUMBAI: The GST-Authority for Advance Rulings (AAR) Karnataka bench has ruled that the goods and services tax (GST) is not applicable on the sale of plots, even if the plots are sold after basic necessities-related works have been completed (such as land leveling, installation of sewage lines, et al).

The land has always been clearly exempt from GST. GST is charged. However, a never-ending battle erupted over whether the sale of plots following basic development is subject to GST. This case is nearing its end.

“This advance ruling is in response to the circular issued by the Central Board of Indirect Taxes and Customs (CBIC) following the GST Central Council meeting on August 3,” Harpreet Singh, indirect tax partner at KPMG-India, explained. This circular states that even the sale of plots after some basic development is considered a sale of land and is exempt from GST. However, services used to develop the land, such as land leveling and drainage line installation, will be subject to GST. The CBIC’s clarification and this advance ruling clear the air on the application of GST to land sales.”

Plots are typically sold to individuals for the purpose of constructing their own homes after the seller has completed some basic development (land owner). In this case, Rabia Khanum, an unregistered individual under GST laws, attempted to convert her land on the outskirts of Bengaluru into a residential site. The land will be developed in accordance with the District Town and Country Planning Act, she stated.

Land development entails laying of electricity cables, water pipes, sewerage lines, drilling of bore-wells, setting up of a power substation, and obtaining a connection from the electricity board.
The authorities would not grant permission to sell plots to individuals for house construction unless these basic necessities were met.

She sought a response on whether GST was applicable on the advance received/sale consideration for such sites, as well as whether GST would apply on the ‘sale of plots after completion of works related to basic necessities,’ and received a favorable response that it was not.

To address a major problem with saltwater intrusion, the government has approved a proposal to build two barrage-cum-bridges across the Sita River in Brahmavar taluk. According to Udupi MLA Raghupathi Bhat, the barrages, which will be built in two locations in Brahmavar taluk, will help the district prevent saltwater from entering the river.

According to him, saltwater intrusion affects agriculture on the banks of the Sita River, and people are facing a potable drinking water shortage crisis. A proposal to build two barrages across the Sita River for Rs 311.25 crore has been approved by the state cabinet.

The barrage proposal was approved by the government in response to people’s demands for an integrated drinking water scheme, according to the MLA, who thanked chief minister Basavaraj Bommai and minor irrigation minister K Madhuswamy.

Indeed, Bhat and Kundapur MLA Haladi Shrinivas Shetty submitted a memorandum to construct barrages across the Sita River, which runs through the taluks of Udupi and Kundapur. The first barrage is expected to cost Rs 160.25 crore, while the second is expected to cost Rs 151 crore.

According to Bhat, the construction of barrages will benefit thousands of families in nearby villages.

He stated that the government had previously approved Rs 165 crore for the construction of a barrage-cum-bridge across the Swarna River at Uppoor to prevent saltwater intrusion.

The popular quick response (QR) code is not going to be available by Google for every property that are listed inside the municipal limits. This includes all sorts of properties like Residential, Commercial, Chawls and Special Buildings. This is intended to provide a unique identification code for each property.

The Ahmedabad Municipal Corporation (AMC) is nearing completion of an agreement with Google to help geotag every property in the city, so that a simple unique alphanumeric digital id can designate these properties in order to develop a ‘Unique Address System’ (UAS) for the city, similar to Google’s ‘Plus codes’.

Once the UAS code is entered into Google Maps, it will assist persons in receiving meals and consignments, calling ambulances and cabs, receiving postal deliveries, and even assisting people in safely to your address. These distinct identifiers will serve as Amdavadis’ new ‘smart addresses.’

According to AMC sources, the civic body approached Google six months ago with a request to map city properties. For the past six months, talks have been ongoing to address “important problems” such as data protection. AMC has insisted that an MoU be inked only if Google’s India office, not its California headquarters, is involved in the agreement.

Google has now mapped its Plus Code addresses to a couple of Indian cities, including Pune and Kolkata. There are around 20 lakhs properties, over 15 lakhs of which are formally registered with the municipal corporation for property tax. UAN, or unique addresses for properties, are made up of a set of 20 alphanumeric characters. They won’t be case-insensitive and does not include vowels. On a trial basis, the AMC may ask Google to give codes to homes in a specific ward.

Following their conviction in a cheque-bouncing case in March 2021, the city crime branch arrested two directors of Mumbai-based Ahuja Constructions, 71-year-old builder Jagdish Bhagwandas Ahuja and his son Gautam Ahuja (42), on Friday. Because of the pandemic scenario at the time, no measures were taken to imprison them. They did not contest their conviction.

On Friday afternoon, the two were apprehended near the Bombay High Court. Ahuja Constructions is well-known in Central Mumbai and the western suburbs for its distinctive luxury constructions.

Last March, the 14th Metropolitan Magistrate Court convicted and sentenced them to six months in uncomplicated imprisonment.

They were also ordered to pay Rs 14.7 lakh in compensation to the petitioner within 30 days, or face another three months of simple imprisonment. The complainant is a Breach Candy resident who filed a lawsuit against Ahuja Properties and Developers and its two directors, Jagdish and Gautam Ahuja, under Section 138 of the Negotiable Instrument Act.

In October 2015, the accused sought the complainant for a “friendly loan” of Rs 10 lakh on the condition that it be repaid within 12 months with a 20.4 percent interest rate. He agreed to make the loan because the complainant was a family friend.

The complainant further said that the accused paid two quarterly interest payments on time. However, the cheque for the third quarterly payment of interest was returned unpaid. This led the complainant to lodge a complaint. According to the conviction ruling, he indicated that two cheques for the fourth quarterly interest were likewise returned due to “insufficient balance.”

According to property market sources, many complaints have been launched against the construction firm and its directors in various courts for alleged cheque bouncing.

According to city police, the duo was also arrested under the Maharashtra Protection of Interest of Depositors (MPID) Act.  A couple from Pune accused them of scamming them of Rs 2 crore.
